The National Prosecuting Authority (NPA) has moved swiftly to discipline a prosecutor after a dramatic turn of events in the Kwaggafontein extortion case saw the matter struck off the court roll in the Kwaggafontein Magistrate’s Court on Monday.

The case involves four accused, including Madoda Johannes Sibanyoni, who are facing charges linked to extortion and money laundering.

According to the NPA, the prosecutor handling the matter failed to appear in court for the continuation of the bail application on 18 May 2026. The absence resulted in the matter being struck off the roll, while a warrant of arrest was also authorised against the prosecutor for contempt of court.

The NPA confirmed that disciplinary action is now being instituted against the prosecutor, who will be suspended pending the outcome of internal processes.

Despite the courtroom setback, the South African Police Service (SAPS) in Mpumalanga insists the case against the accused remains strong.

In a media statement issued on Monday, police said the Organised Crime Unit had conducted extensive investigations before arresting the four suspects and enrolling the matter in court.

Police further rejected allegations claiming investigating officers were absent from court, saying the investigation team had arrived at court at 08:45 on Monday morning.

“Strong evidence against the suspects with regard to the matter remains intact,” SAPS said.

The NPA also sought to reassure the public that the case is far from over. National Director of Public Prosecutions, Adv Andy Mothibi, described the incident as “shocking and disappointing” but stressed that the State remains determined to prosecute those accused of criminal activity.

Mothibi said the Director of Public Prosecutions in Mpumalanga is already engaging with investigators to facilitate the re-enrolment of the case.

The NPA added that the matter can only return to court once written authorisation is granted by the Director of Public Prosecutions in Mpumalanga.

Authorities have appealed to the public to remain patient while both the SAPS and NPA work to resolve the situation and continue with the prosecution process.
