Trucker fined for smuggling fake goods

Bento Abilio Cuna, a 40-year-old Mozambican citizen, was sentenced by the Mbombela
Specialized Commercial Crime Court for smuggling counterfeit goods valued at nearly R6
million into South Africa. On November 4, 2023, Cuna attempted to enter through the Lebombo
Port of Entry driving a truck carrying trailers loaded with fake footwear and clothing.

After customs officials searched the vehicle, they discovered the counterfeit haul and
immediately arrested Cuna. The goods, trucks, and trailers were impounded as evidence.
Affidavits were obtained from brand owners confirming the products were illegal counterfeits.

In court on March 11, 2024, Cuna was found guilty of contravening the Customs and Excise Act.
He received a R200,000 fine or a two-year prison sentence, with half suspended provided he
does not commit similar offences over the next five years. The counterfeit goods were ordered
forfeited to the state.

The truck’s owner, who testified during bail proceedings about Cuna’s employment, also faced
penalties. They were forced to pay R135,000 in fines and storage fees to South African customs
officials.

Major General Gerber, the Provincial Head of the Directorate for Priority Crime Investigation
(Hawks), praised the team for swiftly resolving the case and securing a conviction against the
smuggler. Customs enforcement remains a priority to protect legitimate businesses and
consumers.
